These terms govern the use of the ePlan app, the https://eplan.do website and related services (the “Service”), operated by ePlan Systems, S.R.L. (“ePlan”). By creating an account, buying a ticket or using the Service you accept these terms. If you do not agree, do not use the Service.
1. What ePlan is
ePlan is a platform that connects people with events: it lets you discover events, buy tickets and bookings (with or without lodging), receive a digital ticket with a QR code and communicate with the organizer.
Events are organized by third parties (the “Organizers”). The Organizer is solely responsible for its event: that it takes place, its content, dates, venue, capacity, safety, prices and cancellation and refund policies. ePlan acts as a technology intermediary and, where applicable, as a collection agent on the Organizer's behalf. ePlan is not the organizer of events unless expressly stated.
2. Definitions
- “Service”: the ePlan app, the https://eplan.do website, the organizer dashboard and their related features.
- “User” or “you”: anyone who uses the Service, with or without an account.
- “Organizer”: the person or company that publishes an event and sells its tickets through the Service.
- “Ticket”: the right to enter or take part in an event, with or without lodging, represented by a QR code. It is also called a booking.
- “Content”: text, images, comments, photos and messages posted on the Service.
3. Your account
- You must be at least 18 years old, or have the authorization of a parent or guardian.
- The information you provide must be true and kept up to date. Tickets are personal: they are issued in your name.
- You are responsible for keeping your password confidential and for what happens in your account. Tell us immediately if you suspect unauthorized access. You can end sessions under Profile › Security.
- We may suspend or close accounts that breach these terms, are used for fraud or put other users or the Service at risk.
4. Purchases, prices and payments
- The price of each ticket or plan is set by the Organizer and shown before you confirm, with its breakdown (for example, lodging nights and participation). The price may depend on your participant type and on the sales stage in effect.
- Amounts are shown in the currency chosen by the Organizer (Dominican pesos or US dollars). Your bank may apply its own fees or exchange rates.
- A purchase is confirmed when you receive your ticket in the Tickets section. If a balance remains due, you must pay it within the period set by the Organizer; otherwise the booking may be cancelled.
- Each person may hold only one valid ticket per event.
- Card payments are handled by a payment processor. You authorize the charge for the amount shown. ePlan does not store your full card details.
- Tickets are personal. Reselling or transferring them for commercial purposes without the Organizer's authorization is prohibited.
5. Taxes, fees and chargebacks
- The total you see before confirming is what you are charged. Applicable taxes (such as ITBIS) and any service fee are included in that total or shown itemised before you pay.
- If a payment is declined, the booking may be left with a balance due. You can try again with another card under “My payments” or from your ticket.
- If you dispute a charge with your bank (a chargeback) without first trying to resolve it with the Organizer or with us, we may suspend the affected ticket while the dispute is resolved. Fraudulent chargebacks may lead to closure of the account.
- Promotions, presales and discount codes carry the conditions and validity set by the Organizer, cannot be combined unless stated otherwise and have no cash value.
6. Cancellations and refunds
You can cancel your booking in the app, stating the reason. Whether a refund is due, and in what proportion, depends on each event Organizer's policy and on applicable law. If the Organizer cancels the event, you are entitled to a refund of the amount paid. Details are in our Refunds and cancellations policy, which forms part of these terms.
7. Access to the event
To enter you must show your QR code and, if asked, an identity document. Each code is single-use. The Organizer may refuse entry for safety or capacity reasons or for breach of its rules. Keep your code safe: whoever presents it first will be able to use it.
8. Your content and conduct
You keep the rights to the comments, photos and messages you post. You grant us a non-exclusive, royalty-free, worldwide licence to host, display and distribute them within the Service for as long as they remain posted. You can delete your content at any time.
You may not:
- Post content that is illegal, violent, sexually explicit, discriminatory, defamatory or that harasses other people.
- Post content that infringes copyright, trademarks or the privacy of others.
- Impersonate another person, create fake accounts or manipulate likes, comments or followers.
- Send spam or unsolicited advertising to organizers or other users.
- Attempt to access accounts, systems or data without authorization, or interfere with the operation of the Service.
- Use automated means to extract data or buy tickets in bulk.
We may remove content that breaks these rules and suspend whoever posts it. To report content, write to [email protected].
9. Messages and notifications
Chat is for communicating with the Organizer's team about their event. Messages are tied to your account and the Organizer can see and answer them from the dashboard. Do not use it to send card details, passwords or other people's sensitive information.
You agree to receive electronic communications relating to the Service (confirmations, notices and verification codes) at your account's email address and, if you turn them on, by push notification.
10. Organizers
Anyone who publishes events through ePlan is also bound by their contract with ePlan Systems, S.R.L.. In every case, the Organizer represents that it holds the permits and licences its event needs, that the information it publishes is true, that it will honour the cancellation and refund policy it announces, and that it will handle attendees' data in accordance with the law.
11. Intellectual property
The app, the site, the ePlan brand, its design and its software belong to ePlan Systems, S.R.L. or its licensors. We grant you a limited, personal, revocable and non-transferable licence to use the Service under these terms. The names, logos and images of events belong to their respective Organizers.
12. App stores
If you download the app from Apple's App Store or from Google Play, you also accept their terms of use. These terms are an agreement between you and ePlan, not with Apple or Google, which are not responsible for the Service or its content, have no obligation to provide maintenance or support and are not liable for claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms as regards the iOS app and may enforce them.
13. Availability and warranties
We work to keep the Service available and working properly, but it is provided “as is” and may suffer interruptions, errors or changes. We do not guarantee that events take place, or their quality or safety, which are the responsibility of their Organizers. Nothing here limits the rights the law gives you as a consumer.
14. Limitation of liability
To the extent permitted by law, ePlan is not liable for indirect damages, loss of profits or damages arising from the conduct of Organizers, other users or third parties, or from the cancellation, modification or running of events. Our total liability to you for a purchase is limited to the amount you paid for it through the Service. These limits do not apply in cases of wilful misconduct or gross negligence, or where the law does not allow them to be excluded.
15. Indemnity
If you breach these terms or the law when using the Service and that leads to a third-party claim against ePlan, you must answer for the reasonable damages and costs this causes us, to the extent permitted by law.
16. Force majeure
Neither ePlan nor the Organizer is liable for failures caused by events beyond their reasonable control, such as natural phenomena, health emergencies, decisions of authorities, or widespread telecommunications or power failures. This does not affect your right to a refund when an event is cancelled.
17. Suspension and closure
You can close your account at any time by following the steps under “Delete my account”. We may suspend or close your account, with notice where possible, if you breach these terms, if the law requires it or if we detect fraud or risk to other users. Closure does not affect tickets already paid for upcoming events, unless they were obtained fraudulently, nor obligations that arose before closure.
18. Privacy
The processing of your personal data is governed by our Privacy policy.
19. Changes
We may change the Service and these terms. We will publish the current version with its date and, if the change is significant, give you reasonable notice. If you keep using the Service after it takes effect, you will be taken to accept the changes. You can stop using the Service and ask for your account to be deleted at any time.
20. Governing law and disputes
These terms are governed by the laws of the Dominican Republic, including General Law No. 358-05 on the Protection of Consumer or User Rights. Before going to court, we invite you to write to us at [email protected] to find a solution. Disputes will be submitted to the competent courts of Santo Domingo, without prejudice to your rights as a consumer before Pro Consumidor.
21. General provisions
- Entire agreement: these terms, the Privacy policy, the Cookie policy and the Refunds and cancellations policy are the entire agreement between you and ePlan regarding the Service.
- Severability: if a clause is found invalid, the rest remain in force.
- No waiver: not enforcing a right at a given time does not mean we waive it.
- Assignment: you may not assign your rights without our consent. ePlan may assign its own to a group company or a successor, preserving your rights.
- Language: these terms are published in Spanish and English. If they differ, the Spanish version prevails.
